The terms, plainly.

Effective August 12, 2026· NextHaus, a Motiv Media, LLC property ("NextHaus," "we," "us"). By creating an account or using nexthaus.co you agree to these terms.

01What NextHaus is

NextHaus is software: it builds and hosts real-estate marketing — property listing websites, agent, team, and brokerage websites, and related marketing assets — for licensed real-estate professionals. NextHaus is not a real-estate brokerage, is not your broker, and does not provide legal advice. Nothing the product generates, suggests, or renders is legal advice.

02Your account and your license

You must be (or act with the authority of) a licensed real-estate professional to publish. You warrant that the license information you provide — numbers, states, your broker or brokerage affiliation — is accurate and current, and that you will update it when it changes. We verify what we can against state records; verification helps you, but it does not transfer responsibility for accuracy to us. One account per license.

03Your content and rights

You retain ownership of what you upload. You grant us the license needed to host, process, transform (including AI processing such as copy generation, image enhancement, and staging), and publish it on your behalf. You warrant that you have the rights to everything you publish through NextHaus — photographs, listing data, testimonials, and imported content included. Import tools operate at your direction on listings you represent; you are responsible for having the right to use what you import.

04Professional responsibility — the important one

Real-estate advertising is regulated, and the rules differ by state. NextHaus does its best to get this right for you automatically: we research state advertising rules, render required identity elements (your name as licensed, license numbers with state-correct labels, your brokerage), include state-mandated links and notices where our research identifies them, label AI-modified imagery, and provide MLS-safe unbranded page variants. We build this so that complying takes as little of your effort as possible.

But the published page is your advertising, not ours. You are solely responsible for reviewing everything you publish through NextHaus and verifying that it complies with the laws, regulations, regulator rules, MLS policies, and brokerage policies that apply to you. Our automated compliance features are assistance, not a warranty; we do not guarantee that any page satisfies the requirements of any jurisdiction, and you should confirm requirements with your broker or counsel.

You agree not to remove, obscure, or circumvent compliance elements the platform renders — license identification, brokerage identification, fair-housing statements, and AI-content disclosure labels among them.

05Fair housing and lawful use

You will not use NextHaus to publish content that violates fair housing laws or that is deceptive, defamatory, or unlawful. We may remove content or suspend accounts that do.

06Billing

Plans, included active listings, per-listing overage, monthly creative allowances, and trials are as described on the pricing page at the time of purchase. Subscriptions renew until cancelled; cancellation takes effect at the end of the paid period and your sites stay up through it. Fees are non-refundable except where required by law.

07Service, changes, and availability

We improve NextHaus continuously and may add, change, or retire features. We aim for high availability but the service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

08Indemnification

You will indemnify and hold harmless NextHaus and Motiv Media, LLC from claims arising out of your content, your advertising, your violation of these terms, or your violation of any law or third-party right — including regulator actions concerning advertising you published through the service.

09Limitation of liability

To the maximum extent permitted by law, our total liability arising out of the service is limited to the amounts you paid us in the twelve months before the claim, and we are not liable for indirect, incidental, special, consequential, or punitive damages, or lost profits, data, or goodwill.

10Termination

You may cancel at any time. We may suspend or terminate accounts that violate these terms. On termination your published sites come down after the paid period ends; you may export your content first.

11Miscellany

These terms are governed by California law. We may update them; if a change is material we will notify account holders, and continued use after the effective date is acceptance. If any provision is unenforceable, the rest stand. Questions: support@nexthaus.co.
